(a) The Service includes functionality that uses an artificial intelligence (“AI”) that generates audio and visual persona resembling John Bair, and which leverages machine-learning functionality (the “AI Persona”). Your interaction with the AI Persona is with an AI system and not a human. When you utilize the AI Persona, you will get access to the audio and visual persona resembling John Bair, which provides limited information and question-and-answer functionality, which is not a replacement for personalized training, financial advice, treatment-focused therapy, or professional services of any kind. The AI Persona may generally draw on John Baird’s executive coaching techniques to provide helpful suggestions on where Users might seek additional support or training as executives. The AI Persona is not perfect and has limitations. The AI Persona may generate or “hallucinate” inaccurate or misleading results due to factors like data bias, lack of complete information, or limitations in the underlying technology. The information provided by the AI Persona is for informational purposes only and should not be solely relied upon for important decisions. The AI Persona outputs are generated through machine learning processes and are not tested, verified, endorsed, or guaranteed to be accurate, complete, or current by ExecCoach. You should independently review and verify all the AI Persona outputs as to appropriateness for any or all of your uses of the output information. You are responsible for verifying the accuracy of any information provided by the AI Persona and for consulting with a qualified professional when necessary. All conversations will be deleted as soon as allowable by the third-party vendor that produces the AI Persona and will not be retained by ExecCoach in any form

(b) By interacting with the AI Persona, you acknowledge and agree to the following: (i) the AI Persona is designed to offer general advice and support and cannot offer advice outside the ExecCoach library of resources; (ii) the AI Persona is not intended to replace face-to-face psychotherapy, diagnose, prognosis, treat, or cure a disease/condition/disorder or disability, or provide any type of state-regulated mental health services in your country of residence; (iii) you are fully responsible for your physical and mental wellbeing while you are interacting with the AI Persona including for all of your choices and decisions and you expressly assume the risks of your interaction with the AI Persona; (iv) you will use commercially reasonable efforts to keep your conversations private and your device secure by following the best practices outlined in the Privacy Policy; (v) you first consulted a healthcare professional before using the AI Persona if you have any medical conditions, including but not limited to severe mental or physical conditions or disorders; and (vi) notwithstanding anything in these Terms to the contrary, you waive and release ExecCoach, and its employees, directors, and officers, from any and all liability, damages, causes of action, allegations, suits, sums of money, claims, and demands whatsoever, you ever had, now have or will have, arising from your interaction with the AI Persona. Due to the nature of AI features, ExecCoach cannot represent or warrant that the AI Persona output will not (y) incorporate or reflect third-party content or materials or (z) infringe third-party intellectual property rights. If you do not agree to the foregoing terms, you will not interact with the AI Persona. ExecCoach may terminate your access to the AI Persona at any time, at its sole discretion, for any reason, including if you violate these Terms.

(c) You acknowledge and agree that we may use anonymized data provided by you to train and improve the AI Persona and machine learning algorithms. This usage will be exclusively for the purpose of enhancing the performance and functionality of our Services offered to you and other users. You understand and agree that we may transfer, store, and process minimal data outside your region to enable us to provide Services. These could be regions where data protection laws may be less stringent than those in your country. Such data handling will be based on our Privacy Policy.

(d) If you are having suicidal thoughts or planning to act on suicidal thoughts, or if you feel that you may be a danger to yourself or to others, or if you otherwise have any medical or mental health emergency or severe mental health condition, or if you are in a crisis or trauma or abuse, please discontinue interacting with the AI Persona immediately and call the relevant emergency number in your country or the approved helplines provided by your institution.
